One structure. Clearly explained.

The land. The legal landowner, the Lessor, retains ownership of the land. The purchaser, the Lessee, receives registered lease rights over the specifically identified leased portion.

The villa. The Lease Agreement states that the Lessee owns buildings or structures constructed by the Lessee during the lease, subject to the agreement.

The initial term. The 30-year term starts on the Lease Registration Date. The agreement requires registration within 30 days from the agreement date. Registration fees, applicable taxes and land and building taxes attributable to the leased land are allocated to the Lessee.

The community. Shared infrastructure and common areas are intended to be managed within the estate. Residence charges and services are described separately.

Planning for the future.

The contractual renewal mechanism

A written renewal request may be made at any time before the existing lease ends. Following the request, the Lessor agrees to extend the Unit lease or, where applicable, terminate the existing agreement and enter into a new 30-year Unit Lease Agreement in accordance with the Lessee’s request. The requested agreement is to be registered within 30 days after receipt of the written request.

THB 900,000 is payable to the Lessor each time the lease is renewed or adapted under this clause, plus applicable registration fees, taxes and expenses. Renewal requires the contractual process and registration; it is not an already registered additional term.

Selling or transferring your villa

Assignment of leasehold rights requires the Lessor’s prior consent, which the agreement states must not be unreasonably withheld or delayed. Written consent to an assignment or sublease costs THB 100,000 per occurrence. The agreement also provides for consent to transfer the buildings to the assignee.

An assignment alone does not extend the original lease term. A separate renewal must follow the renewal mechanism in the agreement.

Inheritance and succession

The agreement states that rights and/or obligations bind the relevant heirs or legal successors if either party dies. In the Lessee’s case, the Lessor agrees to consent to transfer building ownership to lawful heirs or testamentary beneficiaries. Appropriate wills and independent succession advice remain part of personal estate planning.

Renting out your villa

Rental and sublease arrangements must follow the Lease Agreement, applicable law and estate rules, including relevant consent provisions. Optional rental management is available through the project’s service packages.

What happens if the lease is not renewed?

At final expiry without renewal, the agreement provides that the buildings and structures vest in the Lessor without compensation.

Owner responsibilities and controlling documents

Owners pay the costs assigned to the Lessee, follow the approval process for structural or external changes, and comply with rental requirements and estate rules. The signed and registered legal documents and applicable Thai law prevail. The Lease Agreement states that the Thai version prevails if Thai and English versions conflict. The Guide recommends independent legal advice before signing.

What about the advertised freehold option?

The sales presentation lists both leasehold and freehold prices. This Ownership Guide describes the leasehold structure. Eligibility and the legal arrangements for a freehold purchase must be confirmed separately for the individual purchaser with the project team and independent counsel.
